It was certainly the most controversial topic among those the <strong>Justice and Home Affairs Council <\/strong>addressed today (Oct. 10) in Luxembourg, which the Hungarian presidency of the Union will use to prepare the work of the<strong> European Council<\/strong> scheduled for next week (Oct. 17-18).<\/p>\n<p class=\"p1\">Mainly on the agenda in the Grand Duchy\u00a0was\u00a0the issue of\u00a0<strong>returns of irregular migrants<\/strong>, aiming to <strong>simplify and make them faster <\/strong>to increase their numbers accordingly. The ministers&#8217; discussions centered around the <a href=\"https:\/\/staging.eunews.it\/en\/2024\/10\/09\/fortress-europe-melonis-line-on-migrant-repatriation-sets-a-precedent-in-the-eu\/\" target=\"_blank\" rel=\"noopener\">controversial idea<\/a>,\u00a0advanced by some 15 member states (including Italy), of <strong>creating &#8220;external hotspots&#8221;<\/strong> (i.e., detention centers) in <strong>third countries close to EU borders<\/strong>, where to\u00a0process asylum claims. In short, the idea is to adopt the &#8220;<strong>Albanian model<\/strong>&#8221; pioneered by Prime Minister <strong>Giorgia Meloni <\/strong>for the whole Union.<\/p>\n<p class=\"p1\">During the press conference at the end of the meeting, the host, Hungarian <strong>S\u00e1ndor Pint\u00e9r<\/strong>, put it this way, &#8220;<strong>The bad guys cannot stay with us, they must be repatriated<\/strong>.&#8221; And he denied that the hotspot proposal was a Hungarian <strong>proposal<\/strong>, in fact defeating his own premier, <strong>Viktor Orb\u00e1n<\/strong>, who had proudly defended it <a href=\"https:\/\/staging.eunews.it\/2024\/10\/08\/orban-in-scena-a-strasburgo-hotspot-esterni-per-migranti-negoziati-con-putin-sullucraina-e-un-monito-lelite-ue-includa-i-patrioti\/\" target=\"_blank\" rel=\"noopener\">solo qualche giorno<\/a> ago during the plenary session of the Euro Parliament in Strasbourg.<\/p>\n<p class=\"p1\">The ministers today <strong>only preliminarily assessed the feasibility of the idea<\/strong> to start\u00a0reflecting on possible solutions in compliance with international and EU law <strong>but without making specific proposals on how to amend the European legislation<\/strong> on the matter <a href=\"https:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=OJ:L:2008:348:0098:0107:it:PDF\" target=\"_blank\" rel=\"noopener\">which dates back to 2008<\/a>:\u00a0a\u00a0working option, as diplomatic sources called it. However,\u00a0\u00a0in the meantime, it has been put on the table for <strong>future elaborations<\/strong>, especially if the <strong>two Italian CPRs across the Adriatic<\/strong> prove to serve their purpose.<\/p>\n<p class=\"p1\">Among the 27 member states, the consensus for a\u00a0<strong>crackdown on irregular immigration<\/strong> is steadily expanding, which is not surprising given the <strong>decisive shift to the right<\/strong> of the political center of gravity in the Old Continent. In addition to the 15 countries that have already asked the Commission to adopt <strong>&#8220;new measures&#8221; to &#8220;increase the effectiveness of returns&#8221;<\/strong> last May &#8211; when\u00a0the <strong>New Pact on Migration and Asylum<\/strong> was adopted &#8211; other member states are also gradually <strong>hardening their position<\/strong>. The French interior minister, the conservative <strong>Bruno Retailleau<\/strong>, said upon his\u00a0arrival at the meeting that Paris &#8220;does not rule out any solution a priori,&#8221; opening up the search for &#8220;<strong>innovative solutions<\/strong>&#8221; such as external repatriation hubs since the current legislation would, in his view, make repatriations &#8220;virtually impossible.&#8221;<\/p>\n<p class=\"p1\">The ministers also discussed the need to <strong>step up\u00a0diplomatic efforts with third countries<\/strong> in order to enter into <strong>repatriation agreements<\/strong>\u00a0according to\u00a0which to expel people they deem undesirable or\u00a0to <strong>incentivize transit countries to detain desperate persons<\/strong> trying to reach Europe before they manage to set sail to risk their lives across the Mediterranean. In short, like\u00a0the agreements struck (bilaterally or at the EU level) with <strong>Turkey and several states in North Africa<\/strong>, from Egypt to Morocco. Retailleau also went so far as to suggest using a &#8220;<strong>diplomacy of migration,<\/strong>&#8221;\u00a0meaning that\u00a0the issuance of visas to third-country nationals with whom there are trade agreements should be conditional on those countries taking in\u00a0their nationals residing illegally on European soil.<\/p>\n<p class=\"p1\">The only\u00a0exception would seem to be <strong>Madrid<\/strong>, led by socialist <strong>Pedro S\u00e1nchez<\/strong>. The PSOE leader <a href=\"https:\/\/www.theguardian.com\/world\/2024\/oct\/09\/pedro-sanchez-unveils-plans-to-make-it-easier-for-migrants-to-settle-in-spain?CMP=share_btn_url\" target=\"_blank\" rel=\"noopener\">defended<\/a> the need for a <strong>migration policy<\/strong> aimed at <strong>openness and welcome <\/strong>yesterday (Oct. 9) for Spain and the EU, <strong>facilitating legal entry routes<\/strong> rather than persecuting illegal migrants. From Luxembourg, representatives of his government reiterated the importance of repatriations with <strong>respect for fundamental rights<\/strong> and for the rules of the <strong>Migration Pact,<\/strong> which are due to come into force at the latest <strong>by the end of 2026 <\/strong>but to which the outgoing Interior Commissioner, <strong>Ylva Johansson<\/strong>, urged full implementation even before that date.<\/p>\n<p class=\"p1\">Regarding\u00a0the <strong>Schengen area<\/strong>, it was noted how the free movement zone is &#8220;<strong>under great migratory pressure<\/strong>,&#8221; Pint\u00e9r&#8217;s said, adding that among the priorities for\u00a0member states must be &#8220;the <strong>resilience of the external borders<\/strong>&#8221; because only through the &#8220;defense and protection&#8221; of the latter will it be possible <strong>to keep the internal ones open<\/strong>.<\/p>\n<p class=\"p1\">Representatives from <strong>Bulgaria<\/strong> and <strong>Romania<\/strong>\u00a0updated their counterparts on progress at the <strong>air and sea borders<\/strong> level.\u00a0However, full integration into the Schengen system will have to wait for a COREPAR decision, which Pint\u00e9r hopes can be reached under Budapest&#8217;s presidency. After all, the <strong>area of free movement<\/strong> has not been enjoying good health lately. Last month,\u00a0<strong>Germany<\/strong> reintroduced controls at all its land borders, while in early October,\u00a0<strong>Denmark<\/strong> also <a href=\"https:\/\/www.thelocal.dk\/20241006\/denmark-increases-controls-at-borders-with-sweden-and-germany\" target=\"_blank\" rel=\"noopener\">announced<\/a>\u00a0that\u00a0it may soon increase security measures at its borders with Sweden and Germany.
